Terms and Conditions

The following Terms and Conditions constitute a legal agreement between Creative Wave Tech (hereinafter referred to as “CWT”) and the Client, governing the use of services provided by CWT, including website design, development, digital marketing, and other related services. By engaging with CWT, the Client agrees to be bound by the terms outlined below.

1. Scope of Services

CWT is a professional web design and digital marketing company offering services in website development (HTML, CSS, JavaScript, PHP, WordPress, etc.), graphic design, corporate branding, social media promotion, software development, mobile app development, print design, and a wide range of digital marketing solutions.

2. Permission and Copyright

• All completed designs, code, images, and files created by CWT remain the exclusive intellectual property of CWT, even after full and final payment, unless otherwise agreed upon in writing.
• The Client is granted a non-exclusive, limited license to use the design or website on a single domain name only.
• Resale, redistribution, or replication of any CWT-developed work without written consent is strictly prohibited.
• The Client confirms that all media and content provided to CWT (images, videos, text, etc.) are either owned by the Client or properly licensed. The Client agrees to indemnify and hold harmless CWT from any copyright or usage disputes.
• CWT reserves the right to include design credits and a link to CWT’s website on all completed projects.
• CWT also reserves the right to showcase completed work in its portfolio or promotional materials.
• The Client agrees to comply with the terms of any third-party software or APIs used within the project (e.g., Google Maps, RSS feeds, Open-Source GPL Software, Creative Commons content, etc.).

3. Project Initiation

The project will commence once the Client provides all required materials and information, including content, images, and payment of the agreed advance amount.

• A design mock-up or homepage layout will be shared within approximately 10 working days (subject to project scope).
• The Client must clearly communicate design preferences (theme, color scheme, layout, etc.) before commencement.
• CWT will provide a maximum of two design revisions at no additional cost; further revisions will be billed separately.
• Project completion timelines depend on the timely submission of materials and approvals by the Client.

4. Content Submission

• Projects begin within 72 hours after advance payment is received.
• The Client must submit complete website/app content within 7 days of project initiation.
• Failure to provide content within the given period will result in an additional charge of 5% of the total project cost.
• An additional 10-day grace period may be granted upon payment of this fee.
• If the Client still fails to provide the required content within this extended period, the project will be cancelled and all payments made will be non-refundable.

5. Project Alterations

• All requested alterations must be communicated within three (3) days after submission of the initial design or draft.
• CWT will not be obligated to make further changes after this period unless agreed upon separately.
• Any major change in structure, layout, or functionality after approval will be treated as a redesign and charged accordingly.

6. Redesign and Final Approval

If the Client requests major changes or redesigns after the project’s completion and approval, such work will be treated as a new project and charged separately.
Upon completion, CWT will upload the project to a testing server for Client review.
The final project will be made live only after Client approval and full payment settlement.

7. Project Cancellation Policy

If the Client fails to provide the required data, approvals, or payments within 60 days of project initiation, the project will be considered cancelled.
All payments made prior to cancellation are non-refundable.
Any future work will require a new agreement and payment and will be treated as a new project.

8. Free Maintenance

CWT offers 3 months of free maintenance to address any runtime technical errors or issues after project completion.
After this period, maintenance charges will apply based on the scope of work.
Please note, free maintenance does not include content updates, design modifications, or page additions, which will be billed separately.

9. Quotation Validity

All quotations issued by CWT are valid for 7 days from the date of issue. Prices are subject to change without prior notice after this period.

10. Material Rights and Usage

CWT reserves the right to refuse to handle or publish:

• Any media or content that is unlawful, inappropriate, or violates intellectual property rights.
• Any file containing viruses or malicious code.
• Any material promoting harassment, violence, obscenity, racism, or illegal activities.

11. Policy Updates

Creative Wave Tech reserves the right to update, modify, or amend these Terms and Conditions at any time without prior notice. Clients are encouraged to review the latest version of this policy periodically.
